Regulatory
Conner Gwyn Schenck PLLC attorneys provide representation in a full range of regulatory issues, including representation before occupational licensing boards, the North Carolina Department of Labor, and the North Carolina Safety and Health Review Board.
We represent individuals and companies requiring assistance in obtaining proper occupational licenses and defending against charges brought by licensing boards. As project delivery systems have advanced well beyond traditional delivery systems, application of contractor and design professional licensing regulations have become more complex. We have helped clients obtain the required licensure and addressed licensure issues in a variety of situations. Our substantial experience and our working relationships with regulatory boards allow us to provide comprehensive representation before occupational licensing boards in both formal and informal venues.
In our OSHA practice, we routinely represent companies charged with violations of safety and health regulations as well as companies seeking guidance on implementation and execution of safety programs and policies. We provide clients with comprehensive representation in all aspects of project safety.
We regularly represent clients in connection with contested OSHA citations before the North Carolina Safety and Health Review Board. We work with our clients, OSHA personnel and the North Carolina Department of Justice to negotiate fair and reasonable settlements of OSHA citations. When a settlement cannot be negotiated, we represent clients in hearing before the Hearing Examiners of the Safety and Health Review Board. We have represented clients on OSHA citations involving fall protection, excavations, personal protective equipment, overhead power lines, energized circuitry, tilt-up wall construction, asbestos containing material, equipment maintenance, manufacturing facility safety and general contractor’s responsibility for work site safety. We have also represented clients in successful appeals of Hearing Examiner’s decisions to the full Safety and Health Review Board.
We are active participants in local and national organizations involved with the regulation of the construction industry, including the regulation of general contractors, fire sprinkler contractors and utility contractors. Our participation in these organizations provides Conner Gwyn Schenck PLLC with the opportunity to appreciate the business aspects of construction and design regulation and apply legal analysis with a full comprehension of the construction industry.
